These Terms and Conditions (“Agreement”) govern the provision of photography and videography services (“Services”) by Anitomix Studios LLC (“Company,” “we,” “our,” or “us”) to the client (“Client,” “you,” or “your”). By booking our Services, you agree to the following terms:
1. Services
1.1. Scope: Anitomix Studios LLC provides photography and videography services as described in the service packages on our website or as agreed upon in writing.
1.2. Customizations: Any additional services or modifications to the scope of the project must be requested in writing and may incur additional fees.
2. Booking and Payment
2.1. Booking Confirmation: A booking is only confirmed when a non-refundable deposit of 50% of the total fee is received. We reserve the right to refuse any booking without a deposit.
2.2. Payment Schedule: The remaining balance is due 14 days before the event date. Failure to make timely payments may result in the cancellation of the booking.
2.3. Late Payments: A late payment fee of 5% may be charged for any balances not paid by the due date.
2.4. Payment Methods: We accept payments via bank transfer, credit card, and PayPal.
3. Cancellation and Rescheduling
3.1. Cancellation by Client: If the Client cancels the booking, the deposit is non-refundable. If the cancellation occurs less than 7 days before the scheduled service, the Client will be responsible for paying 75% of the total booking fee.
3.2. Rescheduling: Rescheduling is permitted, subject to availability, if requested in writing at least 14 days prior to the event. Any rescheduling within 14 days may incur an additional fee of $100.
3.3. Cancellation by Company: In the unlikely event that we need to cancel the Services due to unforeseen circumstances, we will refund any payments received and make reasonable efforts to arrange for an alternative photographer or videographer.
4. Event Conduct
4.1. Client Cooperation: The Client is responsible for ensuring that Anitomix Studios LLC has access to the venue and any necessary permits for the event. The Client shall also ensure that all necessary participants are available at the scheduled time.
4.2. Interference: The Client agrees that no other photographers or videographers, apart from those arranged by the Company, will be permitted to photograph or film the event without prior consent.
5. Post-Production and Delivery
5.1. Editing and Retouching: All images and videos will be professionally edited to the Company’s style and standards. Additional edits beyond the agreed package may incur extra fees.
5.2. Delivery Time: Final edited images and/or videos will be delivered within 4 weeks after the event, unless otherwise agreed upon. Delivery times may vary depending on the complexity of the project.
5.3. Delivery Method: Images and videos will be delivered via an online gallery or USB as specified in the service package.
5.4. Client Review: The Client will have 7 days from the date of delivery to request reasonable corrections or changes. Any major changes or additional editing requests will incur additional fees.
6. Copyright and Usage Rights
6.1. Copyright Ownership: Anitomix Studios LLC retains full copyright ownership of all images and videos created during the course of the Services.
6.2. Client Usage: Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the images and videos for personal or commercial use (as specified in the package), but not for resale or redistribution.
6.3. Company Portfolio: We reserve the right to use any images or videos for promotional purposes on our website, social media, or marketing materials unless the Client requests otherwise in writing before the event.
7. Liability
7.1. Limitation of Liability: In the unlikely event of a significant equipment failure, theft, or any unforeseen circumstances that prevent the completion of the project, the Company’s liability will be limited to a full refund of any amounts paid by the Client. We are not liable for any consequential damages or loss of income.
7.2. Client Responsibility: The Client agrees to indemnify and hold harmless Anitomix Studios LLC and its employees from any claims, damages, or liabilities arising from the conduct of the Client or their guests at the event.
8. Force Majeure
8.1. Neither party shall be liable for any failure or delay in performing obligations under this Agreement if such failure or delay is due to unforeseen events beyond a party’s reasonable control, including but not limited to acts of God, war, terrorism, or other extraordinary events.
9. Governing Law
9.1. This Agreement shall be governed by the laws of the State of Arkansas. Any disputes arising under this Agreement will be resolved in the courts located in Hot Springs, Arkansas.
10. Amendments
10.1. Anitomix Studios LLC reserves the right to update or amend these Terms and Conditions from time to time. Any updates will be posted on our website, and continued use of our Services constitutes acceptance of the revised terms.
11. Agreement to Terms
By booking services with Anitomix Studios LLC, the Client agrees to be bound by these Terms and Conditions.
This Return and Refund Policy outlines the terms under which refunds and service returns are offered by Anitomix Studios LLC (“Company,” “we,” “our,” or “us”). By booking our services, the client (“Client,” “you,” or “your”) agrees to the following terms.
1. Services Provided
1.1. Custom Services: Anitomix Studios LLC provides personalized photography and videography services. Due to the nature of custom creative services, refunds are limited and are provided under specific circumstances as outlined below.
2. Deposits and Booking Fees
2.1. Non-Refundable Deposit: All bookings require a 50% non-refundable deposit to secure the date and time for your photography or videography services. Once paid, the deposit is non-refundable unless the Company cancels the service (see section 5.1 for details).
2.2. Balance Payment: The remaining balance must be paid in full 14 days before the event. Failure to complete payment may result in cancellation of services, and no refund will be issued for any deposits paid.
3. Cancellation and Refunds
3.1. Cancellation by Client: If the Client chooses to cancel the service:
• The deposit is non-refundable.
• If the Client cancels less than 7 days before the event, 75% of the total booking fee is due.
3.2. Rescheduling: Clients may request to reschedule their event or service date. Rescheduling requests must be submitted at least 14 days prior to the scheduled date, and rescheduling within 14 days of the event may incur a $100 rescheduling fee. Any previously paid fees will be applied to the rescheduled date, subject to availability.
3.3. Refund of Balance Payment: If the Client has made full payment but cancels the booking prior to 14 days before the event, the balance payment (excluding the non-refundable deposit) will be refunded. No refunds will be issued for cancellations made within 7 days of the event.
4. Delivery of Products
4.1. Digital Delivery: All photography and videography services result in the delivery of digital products (images and/or videos). Due to the nature of digital files, no returns or exchanges are permitted after delivery.
4.2. Service Satisfaction Guarantee: If the Client is not satisfied with the final product, reasonable corrections or minor edits can be requested within 7 days of delivery. Any major revisions or additional edits beyond the original agreement may incur additional fees.
4.3. Delivery Timeframe: Final images and/or videos will be delivered within 4 weeks of the event date unless otherwise agreed upon.
5. Cancellation by Company
5.1. Cancellation by Company: In the unlikely event that Anitomix Studios LLC must cancel the service due to unforeseen circumstances (e.g., illness, equipment failure), we will offer the Client a full refund, including the deposit. We will also make reasonable efforts to assist the Client in finding an alternative photographer or videographer.
6. Non-Delivery Due to Client
6.1. Client Responsibility: The Client is responsible for ensuring that all necessary information, cooperation, and access to the venue are provided. Failure to do so may result in delays or inability to complete the project. No refunds will be issued in cases where non-delivery is due to the Client’s failure to meet their obligations.
7. Force Majeure
7.1. Neither party shall be liable for delays or non-performance due to causes beyond their reasonable control, including but not limited to acts of God, war, strikes, or other unforeseen events. In such cases, both parties may mutually agree on a new event date without penalty.
8. General Refund Terms
8.1. No Refunds for Completed Services: Once the service has been rendered and digital products (photos/videos) delivered, refunds are not available due to the custom nature of the work provided.
8.2. Customer Satisfaction: We strive for client satisfaction, and reasonable requests for changes within the scope of the project will be honored. However, dissatisfaction with personal preferences (such as creative style) does not constitute grounds for a refund.
